Penalties for a DUI charge vary as every case is going to be different. Some individuals are caught driving drunk more than once while others are only facing their first offense for the crime. Some motorists who drive while intoxicated cause drunk driving accidents while others are responsible for causing property damage. It all comes down to the crime, what happened, where it happened, and what degree of DUI applies to your case. Having a Birmingham DUI defense attorney representing you also plays a role in your case as well.
A DUI charge will increase in severity if a driver causes a drunk driving accident and flees the scene.
While the DUI charges in Birmingham, AL are rather harsh as lawmakers are continually looking for ways to reduce the number of drunk drivers out on the roadway, there are certain things you want to avoid in the event you find yourself being charged with the crime. For instance, although it isn’t the ideal situation to be pulled over and arrested for DUI, the last thing you want to do is provide false information to the arresting officer or to any other law enforcement agent. Making accusations against officers could result in your DUI penalties strengthening and having you facing more consequences than you originally would have been sentenced with.
One Birmingham woman apparently wasn’t aware of this as she accused the arresting officer of raping her. Now, making a rape accusation is a big deal, especially if it involves a police officer. But, one thing 46-year old Venita Kimber failed to take notice of was the body cam the officers were wearing that caught everything on video.
Why Did Kimber Accuse the Officer of Rape?
Back in January, Birmingham officers were dispatched to an accident on the 6000 block of Ivy Street. Witnesses saw Kimber hit three vehicles and a light pole after driving while drunk and fled the scene of the accidents she caused according to al.com. Officers later identified her Dodge Avenger witnesses had seen parked at 6013 Ivy Street and they proceeded to approach the vehicle. They found Kimber in the vehicle and removed her in front of witnesses. She was arrested and placed in the back seat of the officer’s vehicle.
Kimber was then transported to UAB hospital where she informed the nurse that she was raped by the officer at the scene. She stated that she was forced to have oral sex which then promoted the nurse to send her to the SANE (Sexual Assault Nurse Examiners) where a rape kit was performed. She was then taken to Birmingham headquarters where the in-car video along with the body camera footage revealed the officer escorting her into her vehicle, that’s all.
Kimber eventually admitted to her false statement and is now facing charges for DUI, leaving the scene of the accident, and providing a false statement against an officer.
