Rapid City, SD- A South Dakota woman learned last week she would be spending three years behind bars for her 8th DUI conviction.
KSFY reports that 56-year-old Cynthia Goeman was sentenced to three years in jail last week after being convicted of drunken driving for the eight time.
The TV-station reports that Goeman was arrested last July after she was involved in a traffic accident. Goeman pulled out in front of a motorcycle carrying two people. The driver of the motorcycle, a local athlete suffered life-threatening injuries and his passenger had a fractured skull.
In the immediate aftermath of the accident, Goeman’s blood alcohol content was .10, twice the state’s legal limit of .08.
Police later learned the man driving the motorcycle was also drunk, allowing Goeman’s attorney to argue she was not entirely responsible for the collision. That however didn’t keep her from getting a fairly tough sentence for a DUI charge.
Three years for an eighth DUI conviction may seem like much to some, but Goeman’s sentence was a lot tougher than the one handed down to an eight-time DUI offender earlier this month.
In that case, a 42-year-old man was sentenced to six months in jail for his eighth DUI conviction. He was also ordered to serve five years of probation and will have his license suspended for up to three years. Even so, the jail time he received was significantly lower that the three years Goeman received. That is primarily due to the fact that he didn’t cause a drunken driving collision.
The difference in these two sentences shows how the penalties for repeat DUIs in the South Dakota can vary and how much the circumstances surrounding a person’s arrest can impact their penalties. The discrepancy is sentencing also demonstrates the importance of retaining a DUI defense attorney in South Dakota to work on your case.
